• You do not have an active CREA-THUM account.
• You do not reside, are not located, and do not intend to access the platform or services from a restricted location, nor do you act on behalf of a natural or legal person residing in a restricted location. "Restricted Location" includes the United States, Malaysia, Canada, the Netherlands, and others designated by CREA-THUM.
• If acting as an employee or representative of a legal entity and accepting these terms on its behalf, you declare and guarantee that you have all necessary rights and authorizations to bind said legal entity and to access and use the platform and services on its behalf.
• Your use of the platform and services will not violate applicable laws and regulations, including those related to anti-money laundering, anti-corruption, and counter-terrorism financing.
NOTE: Each user may only maintain one main account at a time. The provisions of this clause also apply to the registration, use, protection, and management of commercial accounts.
B. Verification
CREA-THUM acts as custodian of the digital assets stored in our wallets. These assets are assigned upon creating an account and become the property of the user once the identity verification process is successfully completed.
C. Transactions of Digital Assets and Digital Currency
• No Guarantees on Value: CREA-THUM does not guarantee the value of digital assets or any other digital currency. These assets do not have the same status as legal currency and are not protected by institutions such as the FDIC or SIPC.
• Financial Risks: Transactions with digital assets carry inherent financial risks due to their highly volatile nature. Market fluctuations can cause significant changes in the value of these assets in short periods of time.
• Irreversibility of Transactions: Transactions on the digital asset network are verified and confirmed by the network itself, and once executed, cannot be confirmed, canceled, or reversed by CREA-THUM.
• Recommendation for Financial Advice: We strongly recommend that users adequately inform themselves and consider independent financial advice before engaging in transactions with digital assets.
• Other Risks: Users should be aware of risks such as technical issues, cyberattacks, and regulatory changes that could affect the security and value of their digital assets.
D. Third-Party Services
Customers may subscribe to third-party services through CREA-THUM, subject to additional fees and conditions set by the providers of such services.
E. Wallet Address and Private Key
CREA-THUM uses a pair of cryptographic keys to secure transactions. The public key acts as the wallet address, while the private key is necessary to authorize transfers.
F. Account Suspension
You acknowledge and agree that CREA-THUM reserves the right to immediately suspend your CREA-THUM account, as well as any beneficiary accounts owned by related entities or subsidiaries, freeze or block the Digital Assets or associated funds, and suspend your access to CREA-THUM for any reason. This action may be taken if CREA-THUM suspects that any account is in violation of these Terms and Conditions, our Privacy Notice, or any applicable law or regulation.
CREA-THUM assumes no responsibility for permanent or temporary modifications to your account, or for the suspension or termination of your access to our services. Additionally, we reserve the right to retain and use transaction data or other information related to CREA-THUM accounts.
G. Causes for Suspension
Suspension of your CREA-THUM account may apply in the following cases:
• The account is subject to a government process, criminal investigation, or ongoing litigation.
• Unusual or unauthorized activities are detected on the account.
• There is unauthorized access to the account.
• There is a court order or requirement by a regulatory or governmental authority.
H. Account Cancellation
CREA-THUM reserves the right to directly cancel these Terms and your CREA-THUM account under various circumstances, including:
• Interruption of services by CREA-THUM.
• Multiple or indirect registration under a different name.
• False, inaccurate, outdated, or incomplete registration information.
• Refusal to accept modifications to these Terms.
• Circumstances that may harm the operations of CREA-THUM or its services.
